A1. GENERAL TERMS OF USE

Preamble

The domain https://www.co-studios.com/ is an online store selling clothing, underwear, shoes, accessories, and cosmetics (the E-shop) created by the Greek company under the name “KLINIKIDOU S. MONOPROSOPI IDIOTIKI KEFALAIOUCHIKI ETAIREIA” and with the distinctive title “CO_STUDIO P.C.”, which is based in Thessaloniki at 45 Politechneiou street, with Greek Tax Identification Number 801977263 and with Business Registry Number 167451804000 (the Company).

The following terms and conditions shall apply to the use of the E-shop. Every user who enters the E-shop in order to use the services provided by it is deemed to consent and unconditionally accept the following terms and conditions, without any exceptions. If a user does not agree with the following terms and conditions, they shall not carry out any transactions through the E-shop.

General Terms of Use

• The Company reserves the right to freely modify or revise the terms and conditions of the transactions carried out through the E-shop, whenever this is deemed necessary. Users/customers shall immediately be informed of any modification through the pages of the E-shop.
• The Company has the right to freely modify the content of the E-shop, to add or remove products, information, and elements, to modify the prices of the products available in the E-shop, and to temporarily or permanently interrupt its operation, when deemed necessary.
• The transactions carried out and the contracts drawn up through the E-shop shall be governed by Greek Law.

Information Provided

• The Company is committed to the accuracy, truth, and completeness of the information on the products available in the E-shop, of the information provided in relation to the transaction carried through the E-shop, and in general of all the information found on the E-shop’s website.
• The Company is not responsible for and shall not be bound by electronic data entries which were made due to an error or misdirection and it is entitled to correct them whenever it becomes aware of their existence.
• The Company hereby informs users and customers that, for the better service of the latter, the photographic material posted on each product may have minor deviations from the final product delivered and the Company bears no responsibility for such deviations. These minor deviations do not negate the nature and properties of the product as described.

Limitation of Liability

• The Company is not responsible and has no obligation to compensate for any damage or loss arising from the cancellation of orders, the execution, non-execution, or delay in the execution of orders, for any reason, with regard to transactions carried out through the E-shop.
• The Company does not guarantee the availability of the products displayed on the E-shop. The user/customer is informed of the availability or non-availability of the products on the basis of the data kept. When such data changes, the Company undertakes to timely inform users/customers of the non-availability and shall bear no further responsibility.
• The E-shop provides accurate content of the products available through it, including information, names, photos, illustrations, etc.
• Under no circumstances shall the Company bear civil or criminal liability for any damage which may have been suffered by a user/customer of the E-shop or by a third party due to or in relation to the operation or non-operation of the E-shop; or the use of the E-shop; or the inability to provide services, products, and/or information available through the E-shop.

Risk Transfer

• In contracts where the supplier (the Company) ships the goods to the consumer, the risk of loss or damage to the goods is transferred to the consumer when he or a third party designated by the consumer, other than the carrier, has acquired physical possession of the goods.
• However, the risk is transferred to the consumer on delivery to the carrier if the carrier has been instructed by the consumer to transport the goods and this option was not offered by the supplier, without prejudice to the consumer’s rights against the carrier (article 4 situation d of Greek Law 2251/1994).

Intellectual Property Rights

• The distinctive titles, trademarks, images, graphics, photographs, designs, texts, etc., found on the E-shop’s website constitute intellectual property of the Company and are protected according to the relevant provisions of Greek, EU, and International Law. Therefore, any copying, transferring, reproduction, distribution, transmission, or other use of the above content is strictly prohibited.
• The names, images, logos, and distinguishing features that are listed and describe the E-shop or the products made available by the Company or the Company itself, constitute assets of the Company, protected by the relevant trademark laws. Their use in the E-shop does not in any case grant a license or right to third parties to use them.

User Responsibility

Users/customers agree and undertake to use the E-shop and the services, information, and data found on it, as provided by law and in good faith.

Users/customers shall not use the E-shop to:

1. Send, publish, send by e-mail, or transmit in any other way any content that is unlawful for any reason, causes unlawful offense and harm to the Company or to any third party, or offends the confidentiality or privacy of any person’s information.
2. Send, publish, send by e-mail, or transmit in any other way any content that offends users’ morals, social values, minors, etc.
3. Upload, post, send by e-mail, or otherwise transmit any content that users do not have a right to transmit under the law or applicable contracts (such as inside information, proprietary and confidential information obtained or disclosed as part of employment relationships or covered in confidentiality agreements).
4. Upload, post, send by e-mail, or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary right of any third party of any kind.
5. Upload, post, send by e-mail, or otherwise transmit any material that contains software viruses or any other codes, files, or programs designed to disrupt, damage, destroy, or equip operation of any computer software or hardware.
6. Intentionally or unintentionally violate applicable laws or regulations.
7. Harass third parties in any way.
8. Collect or store personal data about other users.

Limited License

• The E-shop, under the terms and conditions set forth herein and all applicable laws and regulations, grants users/customers a non-exclusive, non-transferable, personal, limited right to access and use this website and its contents.
• This right is subject to the following restrictions:
  1. Users/customers must retain all copies of the website and its content as well as all copyright and other proprietary notices.
  2. Users/customers may not modify the website and its content in any way or reproduce or publicly display or distribute or otherwise use the website and its content for any public or commercial purpose, except if otherwise permitted by the present terms.

Links Found in the E-shop

• Links included in the E-shop which lead to pages of e-shops or websites of third-party providers, businesses, etc., are not under the control of the Company and the latter shall bear no responsibility for the contents contained therein, or any changes or updates made to such websites.
• The Company is not responsible for internet broadcasts or any form of transmission received from any linked website.
• The Company only provides such links to facilitate the use of the E-shop and their use is not mandatory for the user/customer.
• The fact that they are included in the E-shop does not indicate that the Company approves or accepts their content.
